DMCA Notice & Takedown Policy | Asfala

DMCA Notice & Takedown Policy

Asfala (https://asfala.com/) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website, we will respond expeditiously to claims of copyright infringement committed using the Asfala website that are reported to our Designated Copyright Agent identified below.

Our administrative operations regarding content integrity are managed from our facility at 6725 Marguerite St, Juneau, AK 99801, United States.

Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

01. Formal Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, please report alleged copyright infringements taking place on or through the Site by completing a DMCA Notice of Alleged Infringement and delivering it to our agent. Upon receipt of the Notice, Asfala will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Site.

Your DMCA Notice must include the following information:

  • 1. Identify the copyrighted work that you claim has been infringed.
  • 2. Identify the material that you claim is infringing (including the URL where the material is located).
  • 3. Provide your contact information (Name, address, telephone number, and email).
  • 4. Include a statement that you have a "good faith belief" that use of the material is not authorized by the copyright owner.
  • 5. Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.
  • 6. Provide your physical or electronic signature.

02. Counter-Notification Process

If you believe that your material has been removed by mistake or misidentification, you may submit a written counter-notification to our Copyright Agent. To be effective, the counter-notification must be a written communication that includes the following:

  • Identification of the material that has been removed and the location at which the material appeared before it was removed.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number.
  • Your physical or electronic signature.

03. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Asfala has adopted a policy of terminating, in appropriate circumstances and at Asfala's sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Site for any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

04. Modifications to this Policy

Asfala reserves the right to modify, alter or update this DMCA Policy at any time. We encourage visitors to frequently check this page for any changes. Your continued use of the site after any change in this DMCA Policy will constitute your acceptance of such change.
